Employers shouldn't face lawsuits if an insurer that is part of their benefits package denies an employee a medical procedure. A flood of court cases could drive up premiums for individual beneficiaries and lead some companies to end healthcare benefits.

Since few employers take an active role in deciding what kind of treatment patients receive, few employers would face lawsuits. When workers fall victim to a poor health care benefits package, they should be able to use the system to fight back.
