Mr Hicks is the Australian captured fighting with the Taliban in Afghanistan. He has been turned over to US forces by the Northern Alliance. The capture of Mr Hicks raised a range of legal questions relating to potential offences against Australian law.
 

Prosecution for treason would fail since Australia has not declared war on Afghanistan. Charges under the Crimes (Foreign Incursion and Recruitment) Act would fail because it is unclear who Australia previously recognised as the government of Afghanistan.
