The toughest punishment that John Lee Malvo would face in Maryland would be life without parole. Because of this, the top elected official in Maryland's Montgomery County wants prosecutors in his state to allow Virginia or Alabama to try the case first.

Prosecutors in Maryland say that since their state suffered the heaviest losses, they have the strongest case against Malvo and Muhammad. Authorities must not use legal maneuvering to evade the spirit of Maryland's law banning juvenile executions.
