| It may be unconstitutional for other states not to recognize Vermont's civil unions The Full Faith and Credit Clause of the U.S. Constitution requires states to recognize the "acts, records and proceedings" of all other states. In 1996, the Defense of Marriage Act (DOMA) became law, which gave states the "right" not to recognize gay marriages performed in other states. That law is likely unconstitutional, but there has not yet been an opportunity to challenge it in court. Many legal scholars believe that other states will be constitutionally required to recognize civil unions performed in Vermont. |
